Terms of Service
These terms are the agreement between you and HiddenLots LLC ("we", "us") for your use of HiddenLots (the "Service"), including the website, the web app, alerts, and any data we deliver. By creating an account or using the Service you accept these terms. If you don't agree, don't use the Service.
1. What the Service is
HiddenLots gathers information that is already public — county assessor and parcel records, and posts that people have published openly on the internet — and organizes, scores and ranks it so you can find property that may be available outside the listing services. We also let you save your own notes and clips.
The Service is a research tool. It does not list property for sale, does not represent buyers or sellers, and does not negotiate on anyone's behalf.
2. What the Service is not
- Not a real estate broker or agent. We are not licensed to broker real estate in any state. Using the Service creates no agency, fiduciary or representation relationship between you and us.
- Not legal, financial, tax or investment advice. Scores, signals, rankings and alerts are our automated opinion about public data, nothing more.
- Not a guarantee that any property is for sale. A high score means the public record or a public post suggests something; it does not mean the owner wants to sell, that the information is current, or that any transaction is possible.
3. Accuracy and availability
Public records contain errors, lag behind reality, and vary by county. Posts move, get deleted, and are sometimes wrong. We provide the Service and all data "as is" and "as available", without warranties of any kind, express or implied, including accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. You are responsible for verifying anything before you rely on it or act on it. We may add, change or remove data sources, counties and features at any time.
4. Your responsibilities when contacting owners
The Service can show owner names and mailing addresses from public assessor records. How you use that information is your decision and your responsibility. You agree to:
- comply with all laws and rules that apply to you, including laws on solicitation, mail, telephone and text communication, consumer protection, fair housing and privacy;
- honor any request from a person not to be contacted again;
- follow local rules on signs, door-to-door contact and advertising;
- not misrepresent who you are or why you are contacting someone.
We don't review or approve your communications and we aren't responsible for them. When an owner uses a reply link to tell us they don't want to be contacted, we withhold their name and mailing address from every member and remove the parcel from exports, letters and deal boards; you agree not to work around that.
4a. Deal boards and the operator's first look
Some plans include a board of parcels and posts our rules rate as exceptional ("unicorns"). Disclosure: the operator of the Service buys property for its own account. Before an item is released to the board, the operator may hold it for up to 48 hours (extendable) and may decide to pursue it itself, in which case it is not released. Items the operator passes on are released to members with access. Nothing on the board is an offer, a listing, or a representation that the owner will sell, and the operator owes you no duty with respect to any property it pursues.
5. Acceptable use
You may use the Service for your own property research. You may not:
- resell, redistribute, publish or share the data, exports or alerts, or build a competing product from them;
- scrape, crawl, bulk-download or access the Service by automated means other than the features we provide;
- share your account or create more than one account per person;
- use the Service to harass, intimidate, stalk or discriminate against anyone;
- attempt to interfere with, overload or reverse-engineer the Service.
6. Accounts
You must be at least 18 and give us accurate information. Keep your password private; you're responsible for everything done through your account. Tell us promptly if you think it has been compromised.
6a. Your information and how we keep it
By creating an account you agree that we collect and keep the following about you, in our customer records and the systems we use to run the business (our database, our payment processor, our email provider, and internal spreadsheets or exports we make from them):
- Who you are and how to reach you: your name, sign-in email, phone number, mailing address, and any separate email you choose to print on owner letters.
- Your account and membership: plan, trial and renewal dates, payment status and a Stripe customer reference (never your card number), the counties you watch, your alert settings, and the leads, parcels, notes and saved searches you create.
- Your agreement to these terms: the date and version you accepted.
- Activity needed to run and secure the Service: sign-in times, server logs, and messages you send us.
We use this to run the Service for you, print the letters you ask for, bill you, answer your questions, keep the Service secure, and send you service notices and occasional product updates from HiddenLots LLC. You can turn product updates off at any time in Settings; service notices (receipts, password resets, trial reminders, legal changes) come with the account. We don't sell your information and don't use it for anyone else's advertising. The Privacy Policy has the full detail, including how to get a copy of your data or have it deleted.
7. Subscriptions, trials and payment
- Free trial. New members get a 7-day free trial. A valid payment method is required to start it. If you don't cancel before the trial ends, your subscription begins and the card is charged.
- Renewal. Subscriptions renew automatically, monthly or yearly depending on the plan you chose, until you cancel.
- Cancellation. You can cancel at any time from the Billing page. Cancellation takes effect at the end of the period you've already paid for, and you keep access until then.
- Refunds. We don't refund partial periods, except where the law requires it.
- Price changes. We may change prices with at least 30 days' notice by email. The new price applies at your next renewal after the notice period.
- Payments. Payments are processed by Stripe under its own terms. We don't store your card number.
- Plan limits. Each plan includes a set number of counties and states and specific features. If you downgrade, areas beyond the new limit may be paused.
8. Your content
Notes, clips, saved searches and settings you create are yours. You give us permission to store and process them to run the Service for you. Don't put anything in the Service that you don't have the right to use.
9. Ending the agreement
You can close your account at any time by emailing support@hiddenlots.com. We can suspend or end your account if you breach these terms, if we're required to by law, or if we stop offering the Service; if we end it without cause during a paid period, we'll refund the unused portion.
10. Limitation of liability
To the fullest extent the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost deals, lost data or business interruption, arising from your use of the Service or any data in it, even if we were told it was possible. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so some of them may not apply to you.
11. Indemnity
You'll defend and hold us harmless from claims and costs that arise from your use of the Service, your contact with property owners or anyone else, or your breach of these terms.
12. Governing law
These terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Wisconsin, and you consent to their jurisdiction.
13. Changes to these terms
We may update these terms. If the change is material we'll email you or post a notice in the app at least 14 days before it takes effect. Continuing to use the Service after that means you accept the updated terms.
